Will of Ellinor Swanton

In the Name of God Amen, I, Ellinor Swanton of the City of Cork, Widow, being of sound and disposing mind, memory and understanding, thanks be to God, do make, publish and declare this as and for my last Will and Testament, hereby revoking all former and other Will or Wills by me at any time heretofore made.

I leave and bequeath unto my brothers Robert Swanton and William Swanton the sum of one hundred and fifty pounds each. I leave and bequeath to my Sister Dorothea Evans, Wife of Robert Evans of Ardraleigh, the sum of one hundred and fifty pounds to be paid to her upon her own receipt and for her own sole and seperate(sic) use without the control of her husband. Notwithstanding her Coverture, I leave and bequeath to my sister Bride Jermyn, Wife of Henry Jermyn, the sum of one hundred pounds to be paid to her in like manner for her own sole use Notwithstanding her Coverture, I leave and bequeath unto my Sister Patience Long, Widow, the sum of one hundred and fifty pounds.

I leave and bequeath to the Children of my Sister Dorothea Evans before mentioned the sum of fifty pounds to be equally divided between them. I leave and bequeath unto George Rynnn of Bandon in the County of Cork Ireland the sum of Twenty pounds and I also bequeath unto him my Clock at present in his dwelling house. I leave and bequeath unto Mary Brown, Wife of Jeremiah Brown of Bandon foresaid the like sum of twenty pounds.

I leave and bequeath until Mary Johnson, Wife of Thomas Johnson of the City of Cork, Innkeeper, the sum of Forty pounds.

I leave and bequeath unto my niece, Patience Appleby of Innishannon in the County of Cork the sum of Twenty pounds. I leave and bequeath unto my nephews Thomas Swanton of Ballydehab, Job Swanton of Ballybane and John Evans of Ardraleigh all in the County of Cork the sum of fifty pounds to each.

I leave and bequeath until my niece, Mary Woodrough, Wife of John Woodrough, the sum of twenty pounds. And in case the property I shall die pofsefsed(sic) of shall not be sufficient for the payment of the several Legacies before specified then I order and direct that such defalcation shall be borne proportionably by my Legatees herein before named.

I leave and bequeath my Plate consisting of the following articles Vis:

unto my brothers William Swanton and Robert Swanton & my sd Sisters Dorothea Evans and Patience Long to be equally divided between them.

And as to all the rest, residue and remainder of my property as I shall die pofsefsed(sic) of, after payment of my just debts and funeral expenses, I leave and bequeath the sums until my Nephew Robert Swanton and his Sister Agnes & Ann Swanton, daughter of my brother Robert.

And Lastly I do hereby nominate and appoint my said brothers William Swanton and Robert Swanton and my said Nephew Job Swanton Executors of this, my last Will and Testament.

In Witness whereof I have hereunto put my hand ande Seal this twentieth day of June in the year of our Lord one thousand seven hundred and ninety eight.

Signed Sealed, Published and declared by the Testatrix as and for her last Will and Testament in presence of us who at her request have hereunto subscribed our names as witnefses(sic) in presence of each other. The words "Ann Swanton, daughter of my brother Robert" being first interlined.

First Codicil to Elinor Swanton's Will
July 27, 1798

I, Elinor Swanton of the City of Cork, Widow, do make and publish this as and for a Codicil to my last Will and Testament. Whereas in and by my said Will I left and bequesthed the rest residue & remainder of my property after the legacys therein mentioned to and amongst my nephew Robert Swanton, Agnes and Ann Swanton to be equally divided between them share and share alike.

Now I do by this Codicil leave and bequeath to my nieces, the daughters of William Swanton and Robert Swanton and the daughter of Samuel Swanton and the daughters of Dorothy Swanton and Ann Jermyn, the daughter of Bride Jermyn as also the daughter of Patience Long, the sum of Eighteen pounds each, to be paid to each of them, my said nieces, as also I leave to Jonas Lander the Younger the sum of Ten pounds which said several Legacies to my Nieces and the said Jonas Lander I will & direct might arrise(sic) out of such rest & residue of my effects & substance and after the payment, then I leave & bequeath the rest and residue of such Estate & effects to my niece, Susanna Swanton and my Nephew Robert Swanton share & share alike.

Second Codicil to Elinor Swanton's Will
August 11, 1798

I, Ellen Swanton of the City of Cork, Widow, do make and publish this as & for a further Codicil to my last Will and Testament. Whereas in the Codicil to my said Will I did thereby bequeath to my niece Susanna Swanton and to my Nephew Robert Swanton the rest and residue of my Estate and Effects, it is my Will and intention that the said Robert Swanton shall alone pofsefs(sic) the said rest and residue. I leave and bequeath to my niece Ann Long, daughter of Michael Long, the sum of Twenty Guineas. My Witnefs(sic) whereof I have hereunto set my hand and Seal this 11th day of August 1798.
